Terms of Service

1. Acceptance of Terms

By accessing and using the Entukei Marketing & Communications website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our services.

2. Services

Entukei Marketing & Communications provides marketing consultancy services including but not limited to:

• Marketing strategy development
• Content development and production
• Corporate training and capacity building
• Events management and planning
• Brand strategy and positioning
• Digital marketing services

Specific service deliverables, timelines, and fees will be outlined in individual project proposals or contracts.

3. Intellectual Property

All content, materials, and deliverables created by Entukei Marketing & Communications remain our intellectual property until full payment is received, at which point ownership transfers to the client as agreed in the individual project contract.

You may not reproduce, distribute, or create derivative works from any content obtained from our website without prior written permission.

4. Client Responsibilities

Clients are responsible for:

• Providing accurate and complete information necessary for project execution
• Timely review and approval of deliverables
• Meeting agreed-upon deadlines for feedback and approvals
• Ensuring that content provided to us does not infringe on third-party rights

5. Payment Terms

Payment terms will be specified in individual project proposals. Unless otherwise agreed:

• Invoices are payable within 30 days of issue
• Late payments may incur a 2% monthly fee
• Work may be paused for accounts overdue by more than 45 days

6. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of a project. This includes business strategies, customer data, financial information, and any other information marked as confidential.

7. Limitation of Liability

Entukei Marketing & Communications shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. Our total liability shall not exceed the total amount paid for the specific service giving rise to the claim.

8. Warranties

We warrant that our services will be performed in a professional and workmanlike manner. We do not guarantee specific results, as marketing outcomes depend on many factors beyond our control.

9. Termination

Either party may terminate a project with 14 days' written notice. In the event of termination, the client shall pay for all work completed up to the date of termination.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on this page. Your continued use of our services constitutes acceptance of the modified terms.
